[Notice of Overpayment and Request for Return of Office Key]

Dear Mr. Yoon,

Following your resignation from our company effective January 11, 2025, we have conducted a final review of your payroll records and identified that an overpayment of Eighty Thousand Philippine Pesos (PHP 80,000.00) was made to you.

This overpayment occurred due to a deviation from the standard payroll process. While your final salary was originally scheduled for GCash transfer, you requested urgent cash disbursement on the same day. To accommodate your request, the company processed the payment in cash. However, the scheduled GCash transaction was not canceled in time, resulting in a duplicate payment of the same amount via GCash.

1. Legal Basis

According to Article 2154 of the Civil Code of the Philippines, when a person receives something to which they are not legally entitled due to a mistake, they are obligated to return it. This principle, known as Solutio Indebiti, applies in this case. The amount of PHP 80,000.00 received through GCash was in excess of your legal entitlement and must therefore be returned.

2. Our Requests

In this regard, we respectfully request your cooperation on the following two matters:

B. Return of Company Office Key The company key issued to you prior to your departure has not yet been returned. As this is a matter of office security, failure to return the key within 7 days will require us to replace all related locks. Please note that the full cost of the lock replacement may be charged to you if the key is not returned.

3. Deadline and Legal Action

If both items above are not resolved within seven (7) days of this notice, we will have no choice but to initiate appropriate legal action for debt recovery, including but not limited to a civil case for recovery of the overpaid amount. Please be advised that any legal fees, court costs, and attorney’s fees arising from such action will be borne by you.

4. Request for Communication

We sincerely hope to resolve this matter through mutual understanding and without resorting to legal proceedings. If you are currently facing financial difficulties, we are open to discussing a payment schedule or alternative arrangement. However, in order to proceed, we need you to respond and communicate in good faith.

As we have been unable to reach you via phone or messaging platforms, we are sending this formal notice. We urge you to respond promptly so this matter can be settled without further complications.

3. 기한 및 법적 조치 안내

이 통지를 받은 날로부터 7일 이내에 위 두 가지 사항이 모두 해결되지 않을 경우, 당사는 민사상 채권 회수 절차를 포함한 적법한 법적 조치를 진행할 수밖에 없습니다. 이 경우, 발생하는 법원 수수료, 변호사 비용 등 모든 법적 비용은 윤영규 님의 부담이 될 수 있습니다.

4. 연락 및 협의 요청

당사는 본 건을 법적 분쟁이 아닌, 상호 이해와 협의를 통해 조속히 해결하고자 합니다. 만약 현재 경제적으로 어려움이 있으시다면, 지불 일정 조정이나 분할 납부 등도 협의 가능합니다. 단, 이를 위해서는 윤영규 님의 성실한 연락이 반드시 필요합니다.

현재까지 전화 및 메신저 등 모든 연락 시도가 닿지 않아, 부득이하게 이와 같은 방식으로 공식 통지를 드리는 바입니다. 더 이상의 불필요한 조치 없이 원만히 마무리될 수 있도록 빠른 연락과 협조를 간곡히 요청드립니다.
